What is court marriage?
Court marriage a secular, religion-neutral civil marriage to make your relationship legally official. A legal process where marriage takes place in the court in front of marriage officer or registrar or SDM and in the presence of three witnesses.
Court marriage is defined under the Special Marriage Act, 1954, drafted in the first decade after the constitution as the principal secular for marriage in India. Where a man and women of age 21 and 18 can get married. It permits the couples to marry regardless caste, creed, or religious barriers.
Under the Section 5, the couple need to file a written notice to the registrar office. A 30-day notice is displayed, where the couples get enough time to think and raise a legal objection. If the objection raised is valid under the law, then marriage is dismissed and if not, the process continues.
Once the notice is released, the couple have to appear in the marriage office, give consent, sign a declaration, and the marriage is solemnised. Then a certificate is release which is considered as a strong legal proof of marriage.
